How the crash occurred
The recent California accident happened on a Thursday. According to authorities, an 18-year-old man was speeding in a car and suddenly left the roadway before crashing into a tree. A 19-year-old man was a front-seat passenger in the automobile at the time of the crash and was pronounced dead at the collision scene.
The driver was transported to a medical center for the treatment of his crash-related injuries. Police said they suspected that he was intoxicated and arrested him. His charges include felony DUI leading to injury, causing bodily injury while committing a felony, committing manslaughter while under the influence, driving with no license and greater DUI penalty due to refusing to undergo alcohol testing or having a high blood alcohol level.
How an attorney can help
The man facing DUI-related charges in California has the option of fighting his multiple charges at trial or striking a plea deal with the prosecution. If he goes to trial, prosecutors must prove his charges beyond a reasonable doubt for the man to be convicted. Seeking a plea deal may be the better option if the evidence that the prosecution plans to present at trial appears strong. A plea agreement may lead to lesser charges and/or a lighter sentence than what may result from a guilty verdict at trial. A criminal law attorney can help the defendant determine the most personally favorable route to take given the circumstances surrounding his DUI arrest.
